A law that requires New York nursing homes to spend at least 70% of revenues on direct resident care has survived a major legal challenge, nearly two years after the legislation went into effect to address concerns over understaffing and care quality. A state appellate court ruled the law is constitutional, dismissing a lawsuit filed by 130 nursing homes across the state who had argued the legislation "was the most serious regulatory threat to the nursing home industry."
